Atlantic Yachting Course Booking Terms and Conditions

1. Your Contract

Your contract is with Atlantic Yachting.

The following terms and conditions will be incorporated into every contract between you and Atlantic Yachting.

By making a deposit payment (bank transfer, cash or cheque) you will be accepting the terms and conditions both for yourself and all members of your party and you are therefore advised to read them carefully. Regret, no credit or debit card facilities.

This contract will be construed in accordance with South African Law and it is agreed between us that each will submit to the jurisdiction of the South African Courts.

2. Deposit & Payment

Payment to be made free of bank charges in South African Rand into our bank account, either by EFT or by cash deposit (please provide 1% of course fee for cash deposit bank fee in addition to amount of course fee payable).

Your place on a course is secured once we have received a completed booking form, accompanied by payment of course fees as follows:

  • A 15% deposit of the total course fee is payable when the booking is made.
    • 25% of the total course fee is due 60 days before the course start date.
    • 50% of the course fee is due 30 days before the course start date.
    • For bookings made less than 30 days before course start date, 100% of the course fee is due to secure your booking.

For courses consisting of more than one module, the course start date will be the day that the first module of the course commences.

If the total course fee is not received as scheduled above, Atlantic Yachting Sailing School reserves the right to cancel and/or resell the place booked by the student.

3. Course Cancellation Policy

Cancellation by student:

Cancellation notice must be in writing. The effective date of the cancellation will be the date on which we receive the cancellation notice. Refunds are subject to the following terms:

    • Cancellation notice received by us more than 90 days before course start date: Course fee paid less administration charge of 10% of total course fee will be refunded.
    • Cancellation notice received by us 30 to 90 days before course start date: No refund. Full amount of course fee quoted is due to Atlantic Yachting Sailing School. However, in the event that your place can be resold to another student, your liability will be limited to the administration charge of 10% of the quoted course fee.
    • Cancellation notice received by us 29 days or less before course start date or during the course: No refund. Full amount of quoted course fee is due to Atlantic Yachting Sailing School. However, in the event that your place can be resold to another student, your liability will be limited to an administration charge of 15% of the quoted course fee.

For courses consisting of more than one module, the course start date will be the day that the first module of the course commences.

Cancellation by Atlantic Yachting Sailing School:

Atlantic Yachting Sailing School reserves the right to cancel courses already booked except where the course start date is 28 days or less into the future. Cancellation notice must be in writing. The effective date of the cancellation will be the date on which the student receives the cancellation notice. Refunds are subject to the following terms:

  • If we cancel a course the full course fees already paid by the student will be refunded. Our liability will be limited to course fees already paid to us, but excluding any travel or accommodation costs that may have been incurred by the student.
  • If we request a student to withdraw or dismiss him/her during a course, the full course fees already paid by the student less course fees for courses already completed or commenced, will be refunded except in the following cases where no refund will be made:
    • if the student is dismissed due to gross misconduct, including alcohol misuse (refer to paragraph 6), or drug use or drug possession (refer to paragraph 7).
    • If we request a student to leave because he/she is not adhering to Atlantic Yachting Sailing School’s Code of Conduct.

Refunds will be limited to course fees already paid by the student subject to the above conditions.

For courses consisting of more than one module, the course start date will be the day that the first module of the course commences.

4. Yacht Insurance

Atlantic Yachting will insure and keep insured the vessel used for training against all usual marine risks including third party risks to such an extent as Atlantic Yachting, in its absolute discretion, shall deem appropriate.

Such insurance policy does not cover injury to, loss of life or damage to or loss of property of any person on board the training vessel, against which the student must insure him-/herself prior to the sail training commencing.

Personal effects (jewellery, cameras, cell phones, clothing, computers, etc.) are not covered under Atlantic Yachting Sailing School’s insurance.

Although we take all possible measures to ensure our students’ security, Atlantic Yachting Sailing School, its employees and contractors can not be held liable in any respect in case of loss and/or damage to any student’s property while attending a course with us.

5. Smoking

Smoking is a fire hazard and a dangerous activity on a small vessel. On long distance sailing, smoking may be permitted with prior consent by the skipper and at the absolute discretion of the skipper, at limited times and at a designated position in the vessel.

6. Alcohol

The misuse of alcohol which can lead to disruptive, dangerous or negligent behaviour towards the employees of Atlantic Yachting Sailing School, the course instructor, fellow crew members, the training vessel, the lecture venue or any other property of Atlantic Yachting Sailing School, will result in immediate dismissal of the student from the course.

No refund of course fees paid will be made due to dismissal on the grounds of misuse of alcohol.

7. Drugs

Under no circumstances may drugs be used or brought on board the yachts or in the lecture venue and our office at any time during the course. This provision excludes medical drugs.

The discovery and/or use of drugs by a student, will lead to immediate dismissal from the course.

No refund of course fees paid will be made due to dismissal on the grounds of drug use or the possession of drugs.

8. Accountability of the student

Damage caused to any item belonging to Atlantic Yachting Sailing School beyond normal wear and tear may render the student liable to pay for the item in full or to pay an amount, as determined by Atlantic Yachting Sailing School, to Atlantic Yachting Sailing School, as compensation. This payment must be settled before your departure or the completion of your training, whichever comes first.

9. Mykonos

Please remember that you are a guest of Atlantic Yachting Sailing School at the Mykonos Resort where you have the use of all their facilities. Any unruly behaviour from any student will not be tolerated and you may face eviction from the Resort.

10. Specification of vessel

Atlantic Yachting Sailing School may alter the specification of the vessel if it deems it, in its absolute discretion, necessary to either ensure that the student derives the maximum benefit from his / her course, or to ensure the safety of the student and / or other water users.

11. Force Majeure

Neither party shall be liable if prevented from fulfilling any of its obligations by an incident of force majeure or any other occurrence beyond that party’s control.

When an event occurs that affects the completion of a course (eg. breakdowns), Atlantic Yachting Sailing School will do everything reasonable that is within its power to correct/repair/rectify the situation to meet the aims of the course.

12. Sailing Shoes

Students must wear sailing shoes or light soled trainers. No dark soled shoes will be allowed to be worn on the yachts.

13. Transfer of Booking to Third Party

The student shall not be entitled to transfer his/her booking to any third party without the prior written consent of Atlantic Yachting Sailing School and shall remain liable notwithstanding any transfer of booking made by him / her to any third party.

14. Course Material and Exam Fees

Although we undertake great care to ensure that course material is correct, we cannot be held liable for any damage/loss caused by any inaccuracy in the course material.

Atlantic Yachting Sailing School will not be liable for any damage/loss caused by inaccurate/incorrect course material or training instruments supplied by outside parties.

Course prices exclude all exam fees.

15. Complaints

If a student is dissatisfied with any element of the training, he/she will inform the instructor. The instructor will either rectify the situation, if possible, or refer the complaint to management.

Alternatively, complaints should be made in writing within 28 days of the course completion date.

For courses consisting of more than one module, the course completion date will be the day that the last module of the course ends.

16. Minimum age

There is no minimum age for the following courses:

  • RYA 2 Day Start Sail
  • RYA Basic Navigation & Safety
  • RYA Competent Crew Practical

Students wishing to partake in the following courses should be at least 16 years old:

  • RYA Day Skipper Practical (Tidal)
  • RYA Day Skipper Theory (Shorebased)

Students wishing to partake in the following courses should be at least 17 years old:

  • RYA Coastal Skipper Practical (Tidal)
  • RYA Coastal Skipper Theory (Non-Tidal)
  • RYA Yachtmaster Coastal

Students wishing to partake in the following courses should be at least 17 years old:

  • RYA Yachtmaster Offshore
  • All Career and Gap Year courses

17. Ability to Swim

Students will inform Atlantic Yachting Sailing School if they are not able to swim at least 50 metres in clothes.

18. Adjustment of Booking Conditions, Prices and Advertised Courses

Atlantic Yachting Sailing School reserves the right to alter the above three items if and when necessary.

19. Disclosure of Medical Conditions and Information by Students

An average state of fitness is required to undertake sail training.

The student will inform management and the course instructor of any of the following which applies to him/her, whether it occurred in the past or present, prior to undertaking training:

  • Heart condition
  • Dizzy spells
  • Epilepsy
  • Diabetes
  • Asthma
  • Epilepsy
  • Multiple sclerosis
  • Any mental or emotional condition which require(d) psychiatric treatment eg. depression, breakdown, bipolar isorder, PTSD, etc.
  • Alcohol or drug abuse, past or present
  • Diabetes
  • Asthma
  • Medication (chronic & acute)

Disclosure of the above or any other medical information will not preclude you from any activity, but will assist the instructor to determine the course of action to be taken in the event of a medical emergency.

Failure by the student disclose any of the above, or any other necessary information relating to his/her health, physical condition, emotional stability or medical requirements, will be regarded as a breach of contract, and the student may be requested to leave or be dismissed, if necessary, in both cases without any refund of course fees already paid or any other incidental expenses incurred by the student.

All information disclosed will be treated as strictly confidential.

STUDENTS WANTING TO APPLY FOR MCA COMMERCIAL ENDORSEMENT MUST ENSURE THAT THEY WILL COMPLY WITH THE MEDICAL REQUIREMENTS BEFORE BOOKING FOR THE RELEVANT
COURSES.

CANDITATES WANTING TO BOOK FOR A COASTAL/YACHTMASTER COURSE MUST ENSURE THAT THEY ARE NOT COLOUR BLIND PRIOR TO BOOKING A COURSE.

20. Language

Training will be undertaken in English and students must ensure that they have a working knowledge of spoken and written English.

We reserve the right to request to leave or dismiss a student who does not have sufficient knowledge of English to undertake the training safely and without negatively influencing the other students’ training.

  • Extra money for food & beverages – cooking on board the yacht is encouraged for the experience and to help stretch your budget

Travel Arrangements

If the need be, we can assist you in making arrangements to meet your transport and alternative accommodation needs. We make use of a registered shuttle service between Cape Town and Langebaan.

EVENING BEFORE COURSE STARTS (only by prior arrangement)

We can meet you the day before your course starts between 17:00 and 18:00 at our office. Please make arrangements with our office prior to your arrival.

THE MORNING THE COURSE STARTS

Please meet us at the Atlantic Yachting Office at the Club Mykonos Marina, Agora Square at 08:30. After the first day theory courses will commence at 08:30am and finish by 17:00.
